The Nevada Supreme Court issued a recent decision clarifying that Assembly Bill 273 applies to judicial foreclosure sales or trustee sales that occur on or after the effective date of the statute. The court held “Accordingly, we conclude that the right to deficiency vests upon the sale pursuant to a judicial foreclosure or trustees sale, and thus applying NRS 40. 459 (1)(c) to deficiencies arising from sales that took place before that provision was enacted would effect vested rights.” Sandpointe Apartments, LLC v. The Eighth Judicial District Court, 129 Nev. Adv. Op. 87 (2013).

Senate Bill 286 protects political speech from civil legal actions
by admin Posted: Sunday, 12/8/2013The 2013 Nevada Legislature passed Senate Bill 286 that provides the protection to a person engaged in good faith communications in furtherance of the right to free speech. Speech concerning issues of public concern is immense from a civil lawsuit. The statute, which amends NRS Chapter 176, provides a speedy procedure for dismissing any such action and provides for the recovery of costs and attorney fees as well as civil monetary penalties. If the District Court refuses to dismiss the action then a right of appeal to the Nevada Supreme Court exists.
